1. Acceptance of Terms and Eligibility

Welcome to Brewvex ("we," "us," "our," or "Company"). These Terms of Service ("Terms") govern your access to and use of the Brewvex website located at brewvex.myshopify.com (the "Site"), and all products, services, features, content, and applications offered by Brewvex (collectively, the "Services"). By accessing, browsing, or using the Site or Services, or by placing an order with us, you ("you," "your," or "Customer") agree to be legally bound by these Terms in their entirety. If you do not agree to these Terms, you must not access or use the Site or Services.

You represent and warrant that you are at least 18 years of age and have the legal capacity to enter into a binding contract under applicable law. If you are under 18 years of age, you may use the Site and Services only with the involvement, supervision, and consent of a parent or legal guardian who agrees to be bound by these Terms on your behalf. By using the Site on behalf of a minor, the supervising adult agrees to be responsible for all use of the Site and Services by that minor.

We reserve the right to refuse service, terminate accounts, remove or edit content, or cancel orders at our sole discretion, including if we believe that customer conduct violates applicable law or is harmful to our interests or the interests of other customers.

2. The Store and Products

Brewvex offers a range of products for sale through the Site. We make every reasonable effort to display our products and their descriptions, specifications, colors, dimensions, features, pricing, and availability as accurately as possible. However, we do not warrant that product descriptions, images, or other content on the Site are accurate, complete, current, or error-free. Product images are for illustrative purposes and may not always reflect the exact appearance, color, or packaging of the product you receive. Actual product colors, finishes, and dimensions may vary slightly due to photographic lighting, screen settings, manufacturing variations, or product updates.

All product specifications, features, and materials are subject to change by manufacturers or suppliers without notice. Product availability is subject to change at any time, and we do not guarantee that any product will remain in stock or available for purchase. We reserve the right to discontinue any product or service, limit quantities available for purchase, or impose conditions on the sale of products at any time without prior notice.

Certain products may be available exclusively online through the Site and may have limited quantities. We have made every effort to display the colors and images of our products as accurately as possible, but we cannot guarantee that your device's display of any color or image will be accurate.

3. Orders and Order Acceptance

When you place an order through the Site, you are making an offer to purchase the product(s) in accordance with these Terms. All orders are subject to acceptance by Brewvex. We reserve the right to accept or decline any order for any reason, including but not limited to product availability, errors in product or pricing information, suspected fraud or unauthorized transactions, or failure to meet our eligibility or verification requirements.

Your receipt of an order confirmation email does not constitute our acceptance of your order; it is simply confirmation that we have received your order. We reserve the right to contact you to confirm details of your order and may require additional verification of information before accepting an order. An order is deemed accepted by Brewvex only when the product(s) have been shipped and you receive a shipping confirmation.

If your order is canceled after payment has been processed, we will issue a refund to your original payment method in accordance with our refund procedures outlined in these Terms and our Returns and Refunds Policy.

We reserve the right to limit order quantities, reject orders, or cancel orders in the event of pricing or product description errors, suspected fraudulent activity, or for any other reason at our sole discretion. If an order is canceled after your payment has been processed, we will promptly issue a full refund to the original payment method.

4. Pricing and Sales Tax

All prices displayed on the Site are in United States Dollars (USD) and are exclusive of applicable sales tax. Prices are subject to change at any time without prior notice. The price charged for a product will be the price displayed on the Site at the time your order is placed, subject to our acceptance of the order as set forth above.

Applicable state and local sales taxes will be calculated and added to your order total at checkout based on the shipping destination address you provide. It is your responsibility to ensure that the shipping address you provide is accurate and complete so that the correct sales tax rate can be applied. Brewvex complies with all applicable United States federal and state tax laws, including the California Consumer Privacy Act (CCPA) and California Privacy Rights Act (CPRA) where applicable.

If a pricing error occurs, whether on the Site, in an advertisement, or in any other communication, we reserve the right to cancel any orders placed for products listed at an incorrect price. If your order is canceled due to a pricing error and your payment has been processed, we will issue a full refund to your original payment method.

We do not accept responsibility for pricing, typographical, or other errors in any offer by us, and we reserve the right to cancel any orders arising from such errors.

5. Payment

Payment for all orders must be made at the time of purchase through one of the approved payment methods available on the Site. By providing payment information, you represent and warrant that you are authorized to use the designated payment method and authorize us to charge the total amount of your order (including product price, applicable sales tax, and any other applicable fees) to that payment method.

All payment transactions are processed securely through third-party payment processors. Brewvex does not store complete credit or debit card information on our servers. You agree to provide current, complete, and accurate purchase and account information for all purchases made through the Site, and to promptly update your account and payment information (including email address, payment method, and payment card expiration date) so that we can complete your transactions and contact you as needed.

We reserve the right to refuse or cancel any order if fraud or an unauthorized or illegal transaction is suspected. In the event of suspected fraudulent activity, we may require additional verification or documentation before processing or shipping an order.

If payment cannot be processed or completed for any reason, we will notify you and your order will not be fulfilled until payment is successfully received.

6. Shipping and Delivery

Brewvex currently ships products within the United States. Shipping within the United States is FREE — there are no shipping costs charged on domestic orders. Delivery time is 3-5 working days from the date of shipment. Please note that delivery time is an estimate and may be affected by factors beyond our control, including carrier delays, weather conditions, holidays, customs processing, or other unforeseen circumstances. Brewvex is not responsible for delays caused by third-party carriers or events outside our reasonable control.

Orders are typically processed and shipped within a reasonable handling period after order acceptance. You will receive a shipping confirmation email with tracking information once your order has shipped. It is your responsibility to provide a complete, accurate, and deliverable shipping address. Brewvex is not responsible for orders delivered to incorrect, incomplete, or undeliverable addresses provided by the customer.

Title and risk of loss for products pass to you upon delivery to the shipping carrier. You are responsible for filing any claims with the carrier for lost, damaged, or delayed shipments. We will cooperate with you and the carrier in resolving any shipping issues, but we are not liable for carrier errors, delays, or failures.

7. Returns and Refunds

Brewvex offers a voluntary 30-day return policy for most products. If you are not satisfied with your purchase, you may return eligible products within 30 days of delivery in accordance with the terms of our Returns and Refunds Policy. Please note that the United States does not have a statutory cooling-off period or right of withdrawal for most online sales; our 30-day return window is the Company's own policy and is provided as a customer service.

To be eligible for a return, products must be unused, in their original condition, and in their original packaging. Certain products may not be eligible for return due to hygiene, safety, or other reasons, as set forth in our Returns and Refunds Policy. Customers are responsible for return shipping costs unless the return is due to a defect, damage, or error on our part.

Refunds will be issued to the original payment method once the returned product has been received, inspected, and approved by Brewvex. Please allow a reasonable processing period for refunds to appear in your account, depending on your payment provider's policies.

The Brewvex name, logo, product names, and all related names, logos, product and service names, designs, and slogans are trademarks of Brewvex or its affiliates or licensors. You may not use such marks without our prior written permission. All other names, logos, product and service names, designs, and slogans on the Site are the trademarks of their respective owners.

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Site and Content solely for your personal, non-commercial use and solely in compliance with these Terms. You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any Content from the Site, except as follows: (a) your device may temporarily store copies of Content in RAM incidental to your accessing and viewing that Content; (b) you may store files that are automatically cached by your web browser for display enhancement purposes; and (c) you may print one copy of a reasonable number of pages of the Site for your own personal, non-commercial use and not for further reproduction, publication, or distribution.

THE SITE, ITS CONTENT, AND ANY SERVICES OR PRODUCTS OBTAINED THROUGH THE SITE ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. NEITHER BREWVEX NOR ANY PERSON ASSOCIATED WITH BREWVEX MAKES ANY WARRANTY OR REPRESENTATION WITH RESPECT TO THE COMPLETENESS, SECURITY, RELIABILITY, QUALITY, ACCURACY, OR AVAILABILITY OF THE SITE.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, BREWVEX DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. BREWVEX DOES NOT WARRANT THAT THE SITE, ITS CONTENT, OR ANY SERVICES OR PRODUCTS OBTAINED THROUGH THE SITE WILL BE ACCURATE, RELIABLE, ERROR-FREE, OR UNINTERRUPTED, THAT DEFECTS WILL BE CORRECTED, THAT THE SITE OR THE SERVERS THAT MAKE IT AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS, OR THAT THE SITE OR ANY SERVICES OR PRODUCTS OBTAINED THROUGH THE SITE WILL OTHERWISE MEET YOUR NEEDS OR EXPECTATIONS.

BREWVEX DOES NOT WARRANT, ENDORSE, GUARANTEE, OR ASSUME RESPONSIBILITY FOR ANY PRODUCT OR SERVICE ADVERTISED OR OFFERED BY A THIRD PARTY THROUGH THE SITE OR ANY HYPERLINKED WEBSITE OR SERVICE, AND BREWVEX WILL NOT BE A PARTY TO OR IN ANY WAY MONITOR ANY TRANSACTION BETWEEN YOU AND THIRD-PARTY PROVIDERS OF PRODUCTS OR SERVICES.

SOME STATES DO NOT ALLOW LIMITATIONS ON IMPLIED WARRANTIES, SO THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU. YOU MAY HAVE OTHER RIGHTS WHICH VARY FROM STATE TO STATE.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL BREWVEX, ITS AFFILIATES, DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, SUPPLIERS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OR INABILITY TO USE THE SITE OR SERVICES, ANY PRODUCTS PURCHASED THROUGH THE SITE, ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SITE, OR ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SERVERS OR ANY PERSONAL INFORMATION STORED THEREIN, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STATUTE, OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL BREWVEX'S TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, AND CAUSES OF ACTION ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE SITE OR SERVICES (WHETHER IN CONTRACT, TORT INCLUDING NEGLIGENCE, WARRANTY, OR OTHERWISE) EXCEED
